If you have a total and permanent disability you may be eligible for a TPD (Total disability discharge) for some of your student loans. This would be applicable to a direct loan (William Ford Direct loan), a FFEL program loan (Federal Family Education Loan), or a Perkins loan. A TPD may also be applicable to a TEACH grant service obligation.
Debt Relief Through A Discharge
In order to qualify for this discharge you have to prove to the U.S. Department of Education that you are permanently disabled. You do this by supplying the Department with pertinent information that they evaluate to see if your disability qualifies.
If you are a veteran that is disabled, you can submit your VA documentation supporting your service connected disability. If you are on SSDI you can submit your SSA or SSI benefit statement showing your next scheduled disability review. Or a third option is to submit certification of your disability from your health care provider. The physician must support that you are not able to work because of a physical or mental disability.
This disability must be such that it could result in death, has been ongoing for at least 60 months or is expected to continue for at least 60 months.
If any of this proof is submitted and accepted then you will qualify for the TDP discharge. If you are applying for this type of student loan debt relief you may find it useful to utilize the services of a student loan debt lawyer.
