Student loans are not normally dealt with in either the Chapter 7 or chapter 13 Bankruptcies. This doesn’t meant that there are not some situations where a student who is debt laden should not apply for bankruptcy.
Usually for many students it’s not just student loans that they are faced with. During their time of attending school may have accumulated credit card debt. Some are faced with small private loans and many have car loans. All of the debt has led them into a serious financial situation.
Going bankrupt may not provide relief from the student loans but it might handle all of the other debt. This may then put the student into a better financial situation where they can now handle the payments on their student debt.
